Introduction

These Terms of Service ("Terms") govern your use of the Spam Punch mobile application (the "App") operated by Dadacorn, LLC ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Description of the App

Spam Punch is a free Android application that allows users to filter unwanted incoming calls based on country codes, area codes, and exchange codes. The App uses Android's Call Screening Role to perform call filtering entirely on your device. No backend server, database, or user account is required to use the App.

2. Eligibility

You must be at least 13 years of age to use this App. By using the App, you represent that you meet this requirement. If you are using the App on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms.

3. License

We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on a personal Android device that you own or control, solely for your personal, non-commercial purposes, in accordance with these Terms.

4. Android Call Screening Role

The App requires the Android Call Screening Role to function. This role is exclusive — only one app on your device may hold it at a time. By granting this role to Spam Punch, you understand that other call-screening apps may be unable to use this role simultaneously. You may revoke this role at any time through your device settings.

5. Optional Permissions

Certain features require additional Android permissions, including READ_CONTACTS and POST_NOTIFICATIONS. These permissions are optional and may be granted or revoked at any time through your device settings. Revoking a permission may limit the associated features of the App.

6. Donations

The App includes an optional "Donate" feature that directs you to our website, where a PayPal donation widget is embedded. Donations are entirely voluntary and have no effect on the features or functionality of the App. All donation transactions are processed by PayPal and are subject to PayPal's Terms of Service and Privacy Policy. We are not responsible for the practices or policies of PayPal or any third-party payment processor.

7. No Warranty

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE, UNINTERRUPTED, SECURE, OR THAT IT WILL MEET YOUR REQUIREMENTS. CALL FILTERING IS NOT GUARANTEED TO BE 100% ACCURATE; SOME CALLS MAY BE INCORRECTLY FILTERED OR MAY PASS THROUGH UNFILTERED.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DADACORN, LLC, ITS MEMBERS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR MISSED CALLS, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS COMBINED SHALL NOT EXCEED FIFTY DOLLARS ($50.00), REGARDLESS OF THE NUMBER OF CLAIMS, OCCURANCES, OR THEORIES OF LIAIBLITY.

9. Indemnification

You agree to defend, indemnify, and hold harmless Dadacorn, LLC and its members, officers, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of the App or your violation of these Terms.

10. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the United States and the state in which Dadacorn, LLC is registered, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the App shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, unless prohibited by applicable law.

11. Modifications to the App or Terms

We reserve the right to modify, suspend, or discontinue the App (or any part of it) at any time without notice. We may also update these Terms from time to time. When we do, we will update the Effective Date at the top of this page. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms.

12. Third-Party Links and Services

The App may direct you to third-party websites or services (such as the PayPal donation platform). We are not responsible for the content, privacy practices, or terms of any third-party services. Your use of third-party services is at your own risk and is subject to their respective terms.

13. Termination

We reserve the right to terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion. Upon termination, all rights granted to you under these Terms will immediately cease.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

15. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Dadacorn, LLC with respect to the App and supersede all prior agreements, representations, and understandings.
